These Terms of Service govern your use of the HomeBuyerTools.com.au platform, including all calculators, estimators, tools, and associated content ("the Platform"). The Platform is operated by HomeBuyerTools ("we", "us", "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
HomeBuyerTools.com.au is a software platform. We provide a suite of calculators, estimators, and tools for illustrative and general informational purposes only. Nothing on the Platform constitutes financial, credit, taxation, investment, or legal advice.
We are not a licensed credit provider or credit assistance provider. We do not assess your eligibility for any financial product. We do not recommend any broker, lender, or financial service provider.
When a licensed mortgage broker subscribes to the Platform, the Platform issues them a personalised referral link and a printable QR flyer for distribution to the broker's own referral partners (such as real estate agents, builders, or other introducers). Buyers who arrive at the Platform via a broker's referral link or QR code submit their enquiries directly to that broker. The Platform is the software that facilitates this flow; the underlying referral relationship is between the broker and their partners, governed by whatever arrangements those parties have made independently of us. Where a buyer arrives at the Platform without a broker's referral link, the enquiry is passed to a participating broker who has elected to act as a fallback recipient. A participating fallback broker is not a recommendation by the Platform. Where the fallback mechanism is engaged, the receiving broker's identity is not disclosed to the buyer prior to form submission.
The Platform operates across the following access categories:
Free Tier: Our basic calculators and estimators are available to any visitor at no cost, subject to fair use.
Broker Tier: Licensed mortgage brokers may subscribe to the Platform to enable receipt of enquiries from buyers who arrive via the broker's own referral arrangements with their partners (such as real estate agents, builders, or other introducers). The subscription provides each broker with a personalised referral link, a printable QR flyer, and the ability to receive form submissions from buyers who used those tools. Subscription plans, pricing, free trial periods, and monthly submission allowances are as described on our pricing page at the time of purchase.
We reserve the right to modify, suspend, or discontinue any tier, plan, or feature at any time. Where changes materially affect existing paid subscribers, we will endeavour to give reasonable notice.
Where subscription is required, you agree to:
You are responsible for all activity that occurs under your subscription. We are not liable for any loss resulting from unauthorised use of your activation link.
Paid subscriptions are billed monthly in advance via our payment processor, Stripe. By subscribing you authorise us to charge your nominated payment method on the date of subscription and at the start of each subsequent monthly billing period for so long as your subscription remains active.
If your subscription includes a free trial, no charge will be applied during the trial period. Your nominated payment method will be charged at the conclusion of the trial unless you have cancelled before that date. Trial durations are as described on our pricing page at the time of signup.
You may cancel your subscription at any time through the Stripe Customer Portal, the link to which is included in your activation email. Cancellation takes effect at the end of your current paid billing period, and you will retain full access to the Platform until that date.
We do not provide credits, refunds, or pro-rated reimbursements for any portion of a billing period remaining after you cancel, for unused submissions within your monthly allowance, or for any reason other than as required under applicable consumer law. This applies whether you cancel during a free trial, after a paid period has commenced, or following a tier change.
If you cancel during an active free trial, no charge will be applied and your access will end at the conclusion of the trial period.
Nothing in this clause limits any non-excludable right or remedy you may have under the Australian Consumer Law (see clause 14).
If a scheduled charge to your nominated payment method is unsuccessful, our payment processor will attempt the charge again over a retry period determined by its smart-retry policy. Throughout that retry period, you may receive automated notifications and your subscription will remain active.
If payment cannot be successfully collected by the end of the retry period, your subscription will be cancelled automatically. In the case of a Broker Tier subscription, cancellation will result in the deactivation of any active referral links and the cessation of enquiry routing to that subscriber.
We are not liable for any loss arising from suspension or termination due to a failed payment.
Broker subscribers agree that:
We reserve the right to verify licence status at any time via the ASIC register.
Any referral, introduction, or fee arrangement between a broker and their own referral partners (real estate agents, builders, or other introducers) is the broker's own responsibility. HomeBuyerTools is not a party to those arrangements, does not validate, document, or hold information about them, and accepts no liability for any fee, commission, or obligation arising between a broker and their partners.

We reserve the right to suspend or terminate access for any user who breaches these conditions.
All content, tools, calculators, code, data, and materials on the Platform are the intellectual property of HomeBuyerTools or its licensors. Nothing in these Terms grants you any ownership interest in the Platform or its content.
You may use the Platform for your own personal or professional purposes within the scope of your subscription tier. You may not reproduce, distribute, or commercialise any part of the Platform without our prior written consent.
The Platform is provided on an "as-is" and "as-available" basis. While we endeavour to maintain high availability and continuous uptime, we do not guarantee that the Platform will be uninterrupted, error-free, secure from all threats, or available at all times.
You acknowledge that:
We will use commercially reasonable efforts to restore the Platform as quickly as practicable following any interruption.

All outputs generated by the Platform's calculators and estimators are illustrative only. They are produced from inputs you provide and assumptions built into the software. Results may be incomplete, inaccurate, or not applicable to your specific circumstances.
You are responsible for verifying the accuracy and relevance of any result to your situation. We accept no liability for any loss, damage, or consequence arising from your reliance on any output generated by the Platform, subject to clauses 13 and 14.

The Platform facilitates a buyer's submission of enquiries to a licensed mortgage broker. Once a buyer's details have been shared with a broker — whether that broker was selected via their personalised referral link or via the Platform's fallback routing for unreferred enquiries — any advice, assessment, or service provided by that broker is entirely their own responsibility under their Australian Credit Licence. We are not responsible for the conduct, advice, or outcomes of any broker connected through the Platform, nor for any referral arrangements between brokers and their own referral partners.
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform — whether in contract, tort (including negligence), under statute, or otherwise — is limited to the total fees actually paid by you to us in the one (1) month period immediately preceding the event giving rise to the claim.
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation:
even if we have been advised of the possibility of such damages and regardless of whether such damages arise from a single event or a series of related events.
Nothing in this clause excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied or imposed by any applicable consumer law (including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law set out in Schedule 2 to that Act) which cannot lawfully be excluded, restricted, or modified.
To the extent permitted by law, where the Australian Consumer Law applies and a statutory guarantee is breached by us, our liability for that breach is limited (at our option) to:

Our collection and handling of personal information is governed by our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. Updated versions will be posted on this page with a revised date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Where changes materially affect paid subscribers, we will endeavour to post notice on the Platform prior to changes taking effect, but are not obligated to do so.
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms or your use of the Platform.
